Tier II Reporting
Under the federal Emergency Planning and Community Right to Know Act (EPCRA), facilities that manufacture, use, or store hazardous chemicals above certain amounts at any given time during the calendar year are required to submit reports on their chemical inventories.
A Tier II Report is an annual inventory of stored chemicals that meet or exceed certain thresholds required under Section 312 of the Emergency Planning and Community Right-to-Know Act of 1986 (EPCRA). The purpose is to provide state and local officials, and the public with specific information on potential hazards.
All Tier II reports in Orange County should be submitted through E-Plan. E-Plan is an electronic filing system which satisfies the requirement for a facility to report hazardous materials to local first responders, emergency management, LEPC, and the State. E-Plan can quickly provide responders with important Tier II data such as:
- Maps of the facility and surrounding areas
- Locations of all fixed facilities and proximity to critical infrastructure
- Safety Data Sheets
- Chemical Profiles
- Risk Management Plans
- Facility Contact Information
- And more

Extremely Hazardous Substances (EHS) in amounts greater than 500 pounds or 55 gallons or the Threshold Planning Quantity, whichever is less, must be reported. For a list of EHS chemicals and their TPQ, refer to the EPA Consolidated List of Lists. Any other Hazardous Chemical for which OSHA requires employers to maintain a MSDS or SDS sheet in amounts greater than 10,000 pounds also must be reported.
North Carolina reporting fees for Tier II submissions are $50 per OSHA Hazardous Substance and $90 per EPA's EHS. Fees are capped at $5,000 per reporting facility. Orange County does not have any additional reporting fees. These fees can be paid through E-Plan.
Exemptions
Some facilities need to report, but do not have to pay the fees. These include:
- Family Farms
- State or Local Government Facilities
- Federal Facilities Under Immunity
- Nonprofit Corporations
- Commercial Fuel Stations
- Motor Vehicle Dealerships
You do not need to report:
- Retail gas stations with underground storage tanks containing less than 100,000 gallons of diesel or less than 75,000 gallons of gasoline
- Household products in the same form and concentration as packaged and distributed to the public
